Dear users, welcome to use the translation product developed by Alibaba (hereinafter referred to as Ali Machine Translation). Please read the following articles carefully before use. If any user raises an objection to any article in this agreement, he/she/it can choose not to use Ali Machine Translation; but if the user uses Ali Machine Translation, then his/her/its behaviors shall be deemed as the acceptance of all contents in this agreement. This agreement shall have legal effect on all users and Alibaba.

Chapter I General Provisions

Article 1: Ali Machine Translation is Alibaba product developed by Alibaba to provide users with the language translation service.

Article 2: The ownership, right of operation and right of management shall belong to Alibaba (China) Technology Co., Ltd (hereinafter referred to as "Alibaba").

Chapter II Disclaimer

Article 3: The basic principle of Ali Machine Translation is that the machine automatically learns from a large body of data and then generates the translation result. The translation result is made without any artificial sorting and editing.

Article 4: Ali Machine Translation provides the translation result in an inartificial way, while Alibaba will neither guarantee the correctness or legality of the translation result in any form, nor bear any legal liability.

Article 5: Ali Machine Translation generates the translation result automatically based on the contents typed in by the user, which does not mean that Alibaba agrees with the contents typed in or the contents and standpoint of the translation result.

Article 6: Ali Machine Translation provides the result of machine translation simply based on the contents typed in by the user, but assumes no responsibility for any infringement, dispute and loss incurred by the contents typed in and translation result, or bear any legal liability.

Article 7: Alibaba respects and protects the personal privacy of all users of Ali Machine Translation, but Alibaba hereby reminds that: the contents typed in by the user when using Ali Machine Translation shall not be recognized as the private materials of the user.

Article 8: Alibaba promises to deal with and fix any system failure affecting the normal operation of Ali Machine Translation, but the user agrees that Alibaba shall neither shoulder any responsibility or obligation, nor bear any legal liability for the dispute and loss incurred by such failure. Moreover, Alibaba reserves the right to suspend all or part of the service for maintenance, upgrade or other purposes without any prior notice.

Chapter III Statement of Rights

Article 9: When any user notices Ali Machine Translation infringes his/her/its legitimate right, the obligee shall give the "notice of right" to Alibaba in advance. Alibaba will take measures to remove or modify the related result of machine translation in accordance with the laws and regulations of China as well as government normative documents, and inform the obligee of the result. The individual or unit claiming the right shall make sure to submit the notice of right to Alibaba in the written form of communication. For the benefit of Alibaba dealing with notice of right effectively, please kindly write the notice of right as per the following written form:

1. The obligee can provide the ownership certification of the trademark right, copyright and/or other rights which could be exercised according to law over the contents concerning alleged infringement;

2. Please describe the contents concerning alleged infringement of the legitimate right of the obligee adequately and accurately, and provide the contents typed in for translation and translation result allegedly infringed;

3. Please specify the translation result allegedly infringing the legitimate right of the obligee listed in item 2;

4. Please provide the specific contact information of the obligee, including real name, copy of ID card or passport (for Alibaba natural person), copy of proof of registered unit (for Alibaba unit), mailing address, phone number, fax number and email address;

5. Please include the statement of authenticity pertaining to following contents of notice into the notice of right:

(1) The user is the legal obligee of the contents complained about;

(2) The related contents of Ali Machine Translation reported by the user infringe corresponding legitimate right of the user;

(3) The user confirms that: the user shall bear all legal liabilities incurred if the contents of this notice of right are not fully substantiated.

6. Please add the following statement into the notice of right:

“I hereby declare that all the information in this notice of right is complete, actual and correct, and I am the legal oblige of the contents complained” or “I hereby declare that all the information in this notice of right is complete, actual and correct, and I have been authorized to exercise the right listed in item 2 of this article.”

7. Please sign or seal this paper depending on the user is Alibaba natural personal or Alibaba lawfully established institution or organization, and provide the identification documents (Enterprises or other organizations shall provide the business license or proof of qualification; while individual user shall provide the copy of ID card). Please send the complete notice of right including seven items as aforementioned, related materials, and real and correct contact information to the following address in the written form:

Article 10: If the statement in the notice of right is inconsistent with <the facts, then the submitter of the notice of right shall bear all legal liabilities incurred (including but not limited to the compensations of all kinds of fees and attorney fee). If the above individual or unit is uncertain about whether Ali Machine Translation has infringed his/her/its legitimate right, Alibaba advises he/she/it consult with professionals at first.

Chapter IV Supplementary Provisions

Article 11: Please refer to related laws and regulations of the People's Republic of China for articles and issues unmentioned in this agreement. The laws and regulations of China shall prevail if this agreement conflicts with any law and regulation of China.

Article 12: The interpretation and application of this agreement shall be subject to the laws and regulations of China, but exclude the application of conflict law. If any user raises an objection to this agreement, please stop using the service or file Alibaba lawsuit to the people’s court of the place where Alibaba is domiciled. If the user continues to use this agreement after it has been published or renewed, then the user shall be deemed as the acceptance of the this agreement and renewed versions.
